Emma Johnston is a litigator who advises Canadian and international clients on construction, insurance, product liability, insolvency, and general commercial litigation. She often advises residential, banking, commercial, and industrial construction clients on construction lien matters throughout Canada, including the continued implementation and impacts of prompt payment legislation. She has experience helping clients with a wide variety of construction and commercial litigation matters. Regarding construction liens, she has handled registration and enforcement of lien rights, removal and the defence of lien claims, applications to have liens declared invalid/valid and any and all resulting litigation including insolvency issues, and the identification and enforcement of alternative security, including public works claims, prompt payment options, and bond claims.

Regarding commercial litigation, she has handled the enforcement and defence of claims, summary judgment and summary dismissal applications, contested interlocutory applications, formal and informal settlement negotiations, and proceedings in all levels of court in Alberta. Her work has covered lease disputes and product liability.
